This content, in whole or in part, can not be objected to trade, copy, modification, reproduction, re-transmission, or be transmitted or delivered in any way by any user.
The products and/or the services of third parties that are displayed at smsbts website constitute copyright and industrial property of these third parties, who undertake the responsibility for the content and the services and/or products.
Users accept, agree and conclude an agreement to use smsbts website according to the law and in a proper way, and are subjected, among others, to the legislation concerning the transmission of data from Greece to Members of the European Union and to third countries. As a result, users agree not to use smsbts for purposes including, but not limited to:
- Harming the minors in any way.
- Transmitting or gaining access to content that: i) violates any third parties’ rights (i.e. copyright and industrial property), ii) violates fundamental human rights that are accorded to the national legislation and the European Convention for the Protection of Human Rights and Fundamental Freedoms (i.e. the right of secrecy, the prohibition of discrimination on any ground, including sex, race, colour, language, religion, political placement or other opinion, of national or social nature), iii) is opposed to the law, to honest practices and industrial matters, iv) violates in any way private life as well as individual and social rights of third parties.
- Installing or promoting in any way, any kind of unsolicited or unauthorized advertisement or not-requested by the user electronic messages (spam), chain mails, pyramid systems or undesired content promotion of any other kind, as well as installing and promoting advertisements without having the written consent of Globitel
- Installing, forwarding and/or making available content that contains digital viruses or any other kind of digital code, archives or programs designed to interrupt, destroy or restrain the function of any software or telecommunication’s infrastructure or inhibit other users from using smsbts.
- Not disclosing information that includes personal data of the users or third parties concerning themselves or third parties, either at real time conversations (chats, message boards) or during the use of any services provided by smsbts, which allows the communication of more than two users.
- Making any kind of illegal use of the services. It is expressly forbidden to send messages of sexual, racist or discriminatory content. Any such use may be considered as harassment to a person or an organization.
In any case of illegal or contrary to these Terms and Conditions use of smsbts website, visitors-users are obliged to refund Globitel for any positive or consequential damage. No exercise of the rights occurring from the Terms and Conditions of Use does not imply that Globitel renounces these rights.
ACCESS CODES
- For the access in certain services of smsbts website or to connect to certain websites, Globitel may require the user’s personal data in order to grant to him an Access Code. This data needs to be always true, precise, valid and complete. Users are responsible for all activities that occur under their Access Code and are obliged to immediately notify Globitel, in case of unauthorized use of their code and every (even probable) breach of security. Globitel will not disclose these data to any third parties. Globitel does not undertake any responsibility for any loss or damage that may occur in case third parties make unauthorized or illegal use of the Access Code, due to leak of the code or any other reason, and holds the right to request refund from the user, in case of any damage caused due to unauthorized or illegal use of the Access Code. Globitel holds the right to deny providing an Access Code or to suspend an already provided code or to terminate the service provided to this user and deny any present or future use of smsbts website, in case of violation of the Terms and Conditions of Use.
AVAILABILITY & SECURITY OF THE NETWORK
- Globitel makes legitimate efforts for the maintenance and the availability of smsbts website. However, users accept that Globitel holds the right to modify and/or temporarily or permanently suspend the function of parts or whole of the website, at all times, with or without warning the users, since availability may depend on the users’ infrastructure, other communication networks, the big number of users trying to access simultaneously the website or other reasons. As a result, Globitel does not undertake any responsibility for any kind of damage (positive, consequential, through negligence, contractual or other), that may be caused by the use of smsbts website or the inability to access it, the partial or full disablement of it, the delay, not delivery, cease or bad reception quality of its services or loss of their content, the existence of any kind of faults. PERSONAL DATA

In order to route the messages and bill the provided services, Globitel processes the traffic data and precisely the number, id address of the connection or terminal infrastructure of the visitor/user, the access code, the position data, the date and the beginning and ending time and duration of the communication process, the amount of the data transmitted, information concerning the protocol, the configuration and routing of the service and the network from which the communication begins and ends.
The management, processing and protection of the visitor’s/user’s personal data is liable to the terms of the present article and the relevant provisions of the Greek law (Law 2472/1997) concerning the protection of the individual from personal data as it has been construed by the judgments of the Hellenic Data Protection Authority. Furthermore, the PD 207/1998 and 79/2000 and the article 8 of the Law 2819/2000 and Law 3471/2006 concerning the protection of personal data and private life in electronic communication and the European Law (directives 95/46/EC and 97/66/EC) concerning the protection of individual and the protection of personal data as it is in effect today.
- Globitel pledges not to sell, rent or by any means publish and/or promulgate the personal data of smsbts website visitors/users to any third parties. Globitel may disclose the personal data of visitors/users of smsbts website to third legal and/or natural persons only in case:
- There is an explicit consent of the visitor/user concerning the disclosure of their personal data. - Globitel may use cookies in order to recognize a user.
